In Florida, potential buyers and sellers may work with a real estate brokerage under 1 of 3 relationships. A real estate licensee may change from one brokerage relationship to the other as long as the buyer or the seller, or both, gives consent before the change, and the appropriate disclosure of duties is provided to the buyer and seller.
- Transaction Broker Relationship — It shall be presumed that all licensees are operating in a Transaction Broker Relationship unless a Single Agent Relationship or No Brokerage Relationship is established in writing using the notices shown below. The Transaction Broker Relationship allows a licensee to facilitate a real estate transaction by assisting both the buyer and the seller, but a licensee will not work to represent one party to the detriment of the other party.
- Single Agent Relationship — In a Single Agent Relationship, a licensee represents either the buyer or seller, but not both in the same transaction. The relationship is established in writing using the Single Agent Notice below.
- No Brokerage Relationship — This relationship must be disclosed in writing using the No Brokerage Relationship Notice below.
